Have the legal document prepared first
A power of attorney can transfer significant decision-making authority. Use an attorney or appropriate document provider to prepare the instrument and answer questions about powers, duration, agents, alternatives, and consequences before the notary appointment.
The notary cannot recommend a form, fill in legal provisions, explain whether it protects the principal, or decide which certificate belongs with it.
The principal must personally participate
The person granting authority must personally appear for any notarized signature, communicate directly, and act willingly. An intended agent, relative, caregiver, or professional cannot answer the notary’s identity or willingness questions for the principal.
If illness, medication, fatigue, hearing, vision, or mobility may affect the visit, schedule for the signer’s best time and describe practical accommodations without sending private medical information.
Resolve capacity questions with qualified professionals
A notary does not issue a medical diagnosis or legal capacity opinion. The notary decides only whether the requested notarial act can proceed based on direct interaction and required observations.
If an attorney or receiving institution requires a physician’s statement, additional witness, special language, or another safeguard, arrange it before the visit.
Confirm the identification plan
Locate acceptable identification and compare the signer’s document name with the ID name. Contact the notary in advance about expired or missing identification, name differences, or a possible credible-witness method.
Do not send ID images or numbers through the public website. Share only the identification type, issuing authority, relevant dates, and the nature of any name difference.
Ask about witnesses and certificate instructions
The document preparer or recipient should state whether witnesses are required in addition to notarization and who is eligible. Arrange them before a home or facility visit; do not assume the notary or facility can supply them.
The requesting party should also identify the acknowledgment, jurat, or other certificate required. The notary cannot choose on the principal’s behalf.
Original documents and certified copies
Notarizing the principal’s signature and certifying a copy of a power of attorney are different acts. California Probate Code section 4307 addresses certification of a copy by a notary. Ask the receiving organization what it needs before ordering copies or additional notarizations.

Ask the preparing attorney or recipient to confirm the final document, requested certificate, witness rules, and delivery instructions in writing. Then schedule for a time when the principal can participate without pressure or avoidable fatigue.
A mobile appointment can make execution more convenient, but convenience does not reduce the legal safeguards. Identity, personal appearance, willingness, direct communication, and complete documents remain essential.
